Terms & Conditions:

 

It is important that you read and understand the terms and conditions that will apply to the supply of goods and/or servces before signing.
If there is any term that you do not understand or do not wish to agree to, then please discuss it with us before signing a booking form or instructing us to supply goods and/or servces.
Only sign a booking form if you wish to be bound by the terms and conditions below.

Variations:


No variation to these Conditions shall be binding unless agreed in writing.
Any typographical, clerical or other error or omission in any sales literature, quotation, price list, website, acceptance of offer, invoice or other document or information issued shall be subject to correction without any liability on the part of Mulberry Studio and/or Yorkshire Wedding Photos.
Mulberry Studio and/or Yorkshire Wedding Photos reserve the right to refuse to supply any individual or company at our absolute discretion.

 

Prices:

Any prices quoted or on Yorkshire Wedding Photos website exclude delivery costs and are subject to change. You will be notified of any change in the prices of ordered goods prior to any acceptance of your order.

We reserve the right, by giving notice to you, at any time before delivery to increase the price of the goods which is due to any factor beyond our control. In the unlikely event of there being an increase in the price of goods and or services over 10% of the original quoted or advertised price, you shall, following notice, be entitled to cancel the order at any time before delivery. Where ceremony and/or locations is at a distance of more than 35 miles from LS23 Yorkshire Wedding Photos will charge 50 pence per mile.

 

Payment Terms:

For all clients of Mulberry Studio all products and services are subject to payment terms of 30 days from date of invoice only.
In the case of Yorkshire Wedding Photos, wedding photography deposits are required to secure bookings, these will be deducted form the final invoice.
All deposits are non-refundable, unless Yorkshire Wedding Photos withdraws the offer of sale to the client.
Balance of payment - All balances are payable 21 days before your wedding day. Additional prints, albums, services - payable in full at time of ordering.
For clients of both Mulberry Studio and Yorkshire Wedding Photos- Interest will be charged on late payments. We understand and will exercise our statutory right to claim interest and compensation for debt recovery costs under the late payment legislation if we are not paid according to agreed terms.

 

Cancellation of services:

The client may cancel their contract with Mulberry Studio and/or Yorkshire Wedding Photos at any given time up to 30 days before the date of wedding or photo shoot by sending written notice to Mulberry Studio and/or Yorkshire Wedding Photos office. Mulberry Studio and/or Yorkshire Wedding Photos will reimburse any monies paid LESS any deposit which remains non refundable.Cancellation within 30 days of wedding or photo shoot will result in the full balance being due immediately.

 

Delivery:

These terms and conditions shall not affect the client's statutory rights.
Notification of faulty or damaged goods should be made within a reasonable time of delivery (up to a maximum of 14 days from delivery) and immediately upon discovery.
As soon as we have delivered the goods you will be responsible for them.

 

Artistic Licence:

Mulberry Studio and/or Yorkshire Wedding Photos shall be granted full artistic licence in relation to poses photographed, locations used, style etc at the wedding venue(s) and/or locations.

Due to the vagaries of the weather and the willingness of subjects, it may not be possible to capture certain requested images. No one image shall be deemed 'more important' than any other image or be treated as such.

 

Overruns:

Mulberry Studio and/or Yorkshire Wedding Photos will recover any additional costs as a result of a overrun on the time allocated in line with our current rates. This may include but not exclusively- Parking fines, accommodation costs, meals, out of pocket expenses, fuel, time etc.

 

Copyright:

The 1988 Copyright Design & Patents Act - section 77 & 80 assigns copyright of photographs/digital images to Mulberry Studio and/or Yorkshire Wedding Photos. It is contrary to the act to copy or allow to be copied photographs/digital images captured by Mulberry Studio and/or Yorkshire Wedding Photos by any means.

All negative/digital files remain the property of Mulberry Studio and/or Yorkshire Wedding Photos unless copyright has been purchased by the client for personal use only.
On purchase of a copyright licence Mulberry Studio and/or Yorkshire Wedding Photos will release files to the client with copyright release information. The client shall be solely responsible for the safe keeping of images/files from that point onwards.

 

Notification of Queries and Complaints:

Mulberry Studio and/or Yorkshire Wedding Photos total liability in contract, not (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this order shall be limited to the price of the goods; and
Mulberry Studio and/or Yorkshire Wedding Photos shall not be liable to the buyer for any economic loss, loss of profit, loss of business, depletion of goodwill or otherwise, in each case whether direct, indirect or consequential, or any claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with the order.

 

Governing Law:

This Agreement shall be subject to and constructed according to English Law and the parties agree to accept the exclusive direction of
the Courts of England.
If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state
or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction which that Term or
Condition is illegal, invalid or unenforceable it shall be removed from these Terms and Conditions and the resultant Terms and Conditions shall remain in full force and effect.
Any error or omission in any information, or document issued by us shall be subject to correction provided that the correction does not materially affect the contract.
